Social Vision Pro - Terms and Conditions

1. General Provisions

These Terms and Conditions ("Terms") govern the use of the Social Vision Pro mobile application ("Application"). By downloading, installing, or using the Application, you agree to these Terms.

The Application is designed as a social media management tool to manage, analyze, and automate your Instagram account.

2. Age and Eligibility

• You must be at least 13 years old to use the Application
• If you are under 18, you must use it with the permission of your parent or guardian
• You must be the legal owner of your Instagram account
• You may not use the Application for illegal purposes

3. Account Security and Responsibility

3.1 Account Information

• It is your responsibility to keep your Instagram account information secure
• You should not share your account information with third parties
• If you detect suspicious activity, you should immediately secure your account

3.2 Application Security

• The Application stores your Instagram passwords on your device with 256-bit encryption
• Your passwords are never sent outside the device
• It is your responsibility to ensure the security of your device

4. Application Features and Usage

4.1 Basic Features

• Follower Analysis: View and analyze follower and following lists
• Profile Management: View and manage profile information
• Story Management: View and manage stories
• Statistics: Analyze account performance

4.2 AutoPilot Features

• Automatic Likes: Automatic likes based on specific criteria
• Automatic Comments: Automatic comments on specific posts
• Automatic Follow/Unfollow: Automatic follow and unfollow operations
• Explore and Like: Automatic likes on the explore page

5. Membership and Payment

5.1 Membership Types

• Premium Lifetime: Unlimited access to all features
• Monthly Unlimited: Access to all features with monthly subscription
• Credit Packages: Purchase credits for a specific number of operations

5.2 Payment Terms

• Payments are made through Google Play Store or Apple App Store
• Payment transactions are subject to these platforms' own terms
• Prices may change without prior notice
• Purchase transactions are processed immediately

5.3 Refund and Cancellation

• As these are digital products, refunds are generally not provided, subject to your legal rights
• Subscriptions can be cancelled through Google Play Store or Apple App Store
• Cancelled subscriptions remain valid until the end of the paid period
• Refund requests are subject to the platforms' own policies

6. Legal Usage and Prohibitions

6.1 Prohibited Uses

The following activities are strictly prohibited:

• Activities that violate Instagram's terms of service
• Spam, fake account creation, or manipulation
• Usage that violates others' rights
• Attempts to reverse engineer or hack the application
• Activities that compromise the application's security
• Copyright violations
• Sharing illegal content

6.2 Compliance with Instagram Policies

7. Intellectual Property Rights

The name and logo of Social Vision Pro, other Social Vision Pro trademarks, and all designs, text, images, photos, illustrations, audio clips, video clips, artwork, graphic materials, code, content, protocols, software, and documentation used in the application are trademarks of Social Vision Pro (collectively "Social Vision Pro Marks").

Other trademarks, service marks, graphics, and logos used in connection with the application are trademarks of their respective owners (collectively "Third-Party Marks").

7.1 Brand Usage

• Social Vision Pro Marks and Third-Party Marks may not be copied, imitated, or used in whole or in part without prior written permission from Social Vision Pro or the relevant trademark owner
• The application and content contained therein are protected by copyright, trademark, patent, and other intellectual property and property rights, and these rights belong to Social Vision Pro and its licensors
• The Instagram brand and content belong to Instagram and may not be used without Instagram's permission

7.2 Prohibited Uses

• Copying, distributing, modifying, or using the application for commercial purposes is prohibited
• Reverse engineering, extracting, or modifying the application's source code is prohibited
• Unauthorized use, distribution, or commercial use of application content is prohibited

8. Service Interruptions and Changes

• The application may be temporarily unavailable due to maintenance, updates, or technical issues
• Features may be changed or removed without prior notice
• Some features may not work due to Instagram API changes
• We are not responsible for damages arising from service interruptions

9. Disclaimer

The Application, Services, information on the Application, and use of all related facilities are provided "as is, as available" without any express or implied warranty.

To the fullest extent permitted by applicable law, we disclaim all representations and warranties regarding the application and its contents, including:

• Warranties regarding errors or omissions in the application
• Merchantability, quality, fitness for a particular purpose warranties
• Accuracy, availability warranties
• Non-infringement warranties
• Implied warranties arising from business relationships or trade usage

9.1 Disclaimed Situations

Social Vision Pro is not responsible for the following situations:

• Property Damage: Any property damage arising from your access to and use of Social Vision Pro applications
• Unauthorized Access: Unauthorized access to or use of our secure servers and/or all personal and/or financial information stored therein
• Transmission Interruptions: Interruption or cessation of transmission to or from Social Vision Pro applications or servers
• Malware: Errors, viruses, trojans, or similar malware transmitted to or through the applications by any third party
• Content Errors: Any loss or damage arising from errors or omissions in any content or use of any content sent, emailed, transmitted, or otherwise made available through Social Vision Pro applications
• Instagram Account Restrictions: Instagram's decisions to restrict, temporarily block, permanently ban, or close your account
• Account Closure: Instagram's decisions to permanently close or suspend your account
• API Limits: Daily, hourly, or instant usage limits of Instagram API
• Automated Activity Results: Detection of AutoPilot features by Instagram and resulting account restrictions, blocks, bans, or account closures
• Third-Party Services: Issues with third-party services such as Instagram, Google Play Store, Apple App Store

10. Limitation of Liability

We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or in connection with the mobile application and services provided in the mobile application, your access to, use of, or inability to use the application, your reliance on or downloading from the application and/or services, or delays or errors in information or transmission, regardless of how they arise, due to any act or omission of third parties.

10.1 Types of Damages Covered

Types of damages for which we are not liable include but are not limited to:

• Business or profit loss
• Loss of use, data, or other intangible assets
• Revenue loss
• Expected savings or business loss
• Data or reputation loss
• Loss of use or value of any equipment, including software
• Third-party claims
• All related and incidental costs and expenses

10.2 Contract and Tort Liability

Whether in contract, tort (including negligence or breach of legal duty) or otherwise, we are not liable for any indirect, consequential, collateral, special, or incidental loss or damage you suffer or incur in connection with the application and this Agreement.

11. Indemnity

You agree to indemnify, defend, and hold harmless Social Vision Pro, its parent companies, subsidiaries, affiliates, officers, directors, employees, consultants, and representatives from any and all third-party claims, liabilities, damages, and/or costs (including but not limited to attorney fees) arising from your use of Social Vision Pro applications, your breach of this Agreement, or any infringement by you or any other user of your account of any intellectual property or other right of any person or entity.

11.1 Security Breach Notification

You agree to immediately notify Social Vision Pro of any unauthorized use of your account or any security breach you are aware of.

12. User Responsibilities

• Use the application in accordance with Instagram's terms of service
• Keep your account information secure
• Accept risks arising from application usage
• Comply with laws and regulations
• Respect others' rights
• Use the application only for legal purposes
• Do not infringe third-party rights
• Respect intellectual property rights

13. Account Suspension and Termination

13.1 Automatic Termination

Your rights under this Agreement will immediately and automatically terminate without any notice from Social Vision Pro (Besim) if you fail to comply with any provision of this Agreement.

13.2 Suspension and Termination Rights

Social Vision Pro (Besim), in its sole discretion, may at any time and for any reason or no reason:

• Modify, suspend, or terminate your access to our services
• Suspend or terminate your access to the application
• Suspend or terminate your license under this Agreement
• Disable the application or component features

Social Vision Pro (Besim) has no liability to you or any third party for any such termination or disabling.

13.3 Post-Termination Obligations

Upon expiration or termination of this Agreement:

• You must immediately stop all use of the application
• You must destroy all copies of the application in your possession or control
• Termination does not limit other rights or remedies that Social Vision Pro (Besim) may have at law or in equity

13.4 Termination for Violation

Your account may be immediately terminated in the following cases:

• Violation of these Terms and Conditions
• Violation of Instagram's terms of service
• Engaging in illegal activities
• Compromising the application's security
• Infringing third-party rights

14. Privacy and Data Protection

In accordance with current and applicable personal data protection legislation, all personal data you provide during the use of the Services will be processed in accordance with our Privacy Policy.

Any user who accepts this Agreement is also deemed to have explicitly and unequivocally accepted our Privacy Policy on an informed basis and may exercise relevant rights regarding personal data protection in accordance with the Privacy Policy.

14.1 Permissions and Consents

When using the Social Vision Pro application, we obtain consent for certain applications:

• Location Permission: The application may request permission to use your location information
• Notification Permission: We may request permission to send push notifications

These consents can be obtained through the application or through standard permissions available on your device. Your mobile device platform provides additional tools to control when your device collects or shares certain categories of personal data.

15. Changes

• We may update these Terms and Conditions from time to time
• We will notify users in case of significant changes
• Continued use of the application after changes means you accept the updated terms
• If you do not accept the changes, you should stop using the application

16. Applicable Law and Jurisdiction

Social Vision Pro does not represent or warrant that Social Vision Pro applications or any part thereof are suitable or available for use in any jurisdiction. We may limit the availability of Social Vision Pro applications, in whole or in part, to any person, geographic area, or jurisdiction at any time and at our sole discretion.

16.1 Applicable Law

Regardless of conflict of law principles, the laws of the Republic of Turkey will govern all matters relating to or arising from this Agreement and the use (or inability to use) of Social Vision Pro applications.

16.2 Jurisdiction

You agree to the exclusive jurisdiction and venue of the appropriate courts of the Republic of Turkey for all matters arising from or relating to Social Vision Pro.

16.3 Non-Exercise of Rights

Social Vision Pro's failure or delay in exercising any right, power, or privilege under this Agreement will not operate as a waiver thereof, and the single or partial exercise of any right, power, or privilege will not preclude any other or further exercise thereof or the exercise of any other right, power, or privilege under this Agreement.

16.4 Statute of Limitations

Any cause of action arising from or related to Social Vision Pro applications must be commenced within three (3) years after the cause of action accrues. Otherwise, such cause of action is permanently barred.

17. Severability

If any provision of this Agreement is found to be illegal, invalid, or unenforceable for any reason, that provision will be deemed severable from these terms and will not affect the validity and enforceability of the remaining provisions.
